Cheyenne Cherry Sentenced to One Year For Animal Cruelty

| Print | By | July 16, 2009 11:41 AM

An angry and unrepentant teen ager, shortly after pleading guilty to charges of animal cruelty and attempted burglary at the Bronx Supreme Court in front of Judge Margaret Clancy, stuck out her tongue to a crowd of animal rights advocates waiting to learn Cherry's sentence, and said, "It's dead, bitch!"

To refresh your memory, I wrote a blog item several weeks ago shortly after Cherry's arrest.

16-alg_cherry News Lombard.jpgCherry was arrested after she allegedly stuffed an eight-week-old kitten named Tiger Lily into a lit oven and left the kitten to die a horrific death. Additionally, Cherry and a 14- year old accomplice trashed Valerie Hernandez's apartment, destroying furniture, stealing DVDs and food. Upon her arrest, she told the arresting officers that killing the cat was "just a joke."

During her court appearance yesterday, Cherry denied that she put the kitten in the oven, and blamed her 14 year-old friend, and told the Judge, "I didn't let the cat out."
Authorities said that the pair left the apartment quickly as they did not want to hear the dying cat's cries or desperate scratching at the oven door"

After a plea bargain was arranged, Ms. Cherry was sentenced to only a year in prison. In fact, more than likely she will only serve 6 months of her sentence. Prosecutor Jennifer Troiano said that the reason that the plea bargain was accepted was that her 14-year old "cohort was more culpable" for the heinous crime. The younger girl will face charges in family court due to her young age. Cherry, who is now in jail for a probation violation will be formally sentenced on July 31st. She also waived her right to appeal, and agreed not to keep a pet for three years.

However, this is not Cherry's first offense connected with cruelty to animals. She was arrested a year ago for dog-napping a teacup Yorkshire terrier using a BB gun to threaten the owner. She also had a prior arrest for robbing a man at gunpoint for an iPod.

More than 20,000 people signed an online petition for the sentencing Judge to see, advocating harsh punishment for Cherry. While the dozen animal rights advocates were "thrilled" that Cherry would do time for this crime, they consider her highly dangerous.

I don't know how you feel about the plea bargain arrangement, but I for one am highly disappointed that based on such horrendous acts of cruelty, and prior charges of "kidnapping a dog at gun-point, it seems to me that a one year sentence doesn't even equal a "slap on the wrist" and will certainly not set any strong precedence for which judges sitting on future cases of animal cruelty will have any leverage to substantiate the appropriateness of stronger sentences.

Do you think that Cherry's sentence was fair? What are your feelings? Please leave a comment and share your thoughts.

I think she should have gotten a lot longer than a year. If I had been her judge, she wouldn't have seen the light of day until I have my next period. I had a hysterectomy in 1989.

Cindy July 16, 2009 2:39 PM

This is the kind of person the next time you hear about them it will be about what they did to a child. After her prision time she should be put in a mental institution. I just dont think anyone in their right mind could do such a thing. There is something wrong upstairs with her for sure.

Amy July 16, 2009 3:06 PM

This is one very sick person. She should be put in with the sickest of the sick in prison for the rest of her life. If she will do this to a helpless animal imagine what else she is capable of. I wouldn't want her to live in my city that's for sure.

Di July 16, 2009 4:08 PM

I don't know why anyone is surprised. People get lighter sentences for molesting children.
This girl is a serial killer in the making, and if I had my way she'd be put down. We need to cull her from the herd before she kills again. Since that probably won't happen (sigh), she should be neutered.

Reno July 16, 2009 4:10 PM

Obviously she knew EXACTLY what she was doing since she said she left the apartment in a hurry so as not to hear the kitten's desperate cries or scratching at the oven door. I'm sorry, but put CHERRY in an oven an turn on the gas!! I know that constitutes terroristic threats but I am not one bit sorry and I am seething just reading of this sentence, actually lack therof. She should be locked up in a very hot room and the key thrown away. If I keep going, I will get arrested. Suffice it to say that I do NOT agree with this sentence in the least.

jmuhj July 16, 2009 4:45 PM

Echoing Reno's thoughts, as posted above. But I'M NOT SORRY.

Diane July 16, 2009 7:29 PM

Next time it will be a human baby. This nut should be locked up for 20 years.

Christine July 16, 2009 7:39 PM

I wish I couldn't believe that she is getting away with this, but I can because the sentences are always too light. Our legal system is totally unjust. So when that jerk kills a kid, what are they gonna do? Just make her serve another few years until she comes and strikes again?

Cindy C July 16, 2009 7:41 PM

It's unbelievable that given her lack of remorse she walked out of this virtually unscathed. I'm sure this is not the last we'll hear of her. It's sad to know that someday another animal or person will suffer at her hands. Having faith in Karma, I'm sure at some point in her life she'll reap what she's sown.

Joanne July 16, 2009 8:01 PM

I wish that she could have gotten a longer sentence. Since she got a year a FULL year should be served with no opportunity for parole. This woman is sick. This won't be her last vist to prison I am sure.

Ruth July 17, 2009 1:59 AM

The sentence she received is absolutely ridiculous !! Whether she put the kitten in the oven, or the other girl did, they both walked away and left it to die in agony !
I can only hope that some brave animal rights person will give her the punishment she really deserves !!! If not, the only other just punishment would be that she burns slowly in hell and the sooner the better.

Barbara July 17, 2009 3:28 AM

The sentence she received is ludicrous, she hasn't shown a scrap of remorse and even tried to weasle out and put all the blame on the other moron. She well knew what agony she was leaving that kitten to face and there is no excuse for that. She is a dangerous person and she should be locked up for life or exterminated. I really hope that someone gets her and gives her the sort of rough justice she deserves, and I mean physically! May she rot and roast in the pits of hell, totally conscious and in agony.

Aunty Meat July 17, 2009 8:41 AM

It's a crying shame, that kitten's short life is over forever and she is to walk free in a matter of months. She is a dangerous sadist, maybe next time, because there WILL be a next time, they will realise she should have been locked up for good.

Anonymous July 17, 2009 10:43 AM

If she will do it to an animal, she WILL do it to a person. Lock her up forever.

lex July 17, 2009 10:49 AM

this is unbelievable.. anyone who can cause such horrific pain and suffering to a living creature deserves a much greater punishment. i mean why do we put ppl in jail? bc they are unsuitable and unsafe to live among people... these girls did somethign so horrific and clearly if you are able to cause such suffering and not look back on it this shows they are unfit to live among people.. these girls are disgusting and should be treated as criminals... they are murderers

Michelle July 17, 2009 10:50 AM

Karma is a B*&ch. When this PSYCHO gets out of prison, I am sure that she will be sleeping with one eye open >

kayla mcgee July 17, 2009 10:51 AM

i think that is not along enough sentence. For being cruel to animals you should be put in jail for life that is what i think

Linda July 17, 2009 10:51 AM

After reading this article, she needs some serious psych meds and a good ass beating!!!!
due to overcrowding in the jail system, I will be shocked if she even does the 6 months!!

Rebecca July 17, 2009 11:07 AM

I can't believe someone would do that. I am completely horrified by the nature of some people. That poor kitten. People like her and her friend should be sentenced much more cruelly. If that had been a baby human rather than a kitten the sentence would have been more grave. I think it's wrong that she was only sentenced for a year and she clearly doesn't care that it's only a year. The fact that she doesn't even feel remorse for what she did is even worse, because we can see what this person is capable of. Maybe next time it will be a child. I am just appalled by this story and so many others that are like that in our world.

Kissy Regan July 17, 2009 11:59 AM

Well, she will get much more jail time after she is convicted of killing someone. Very sad that someone will have to die when it is PAINFULLY obvious that this is a sick sadistic person on the loose. Mental health recognizes this to be a fact, but "we can't profile someone, that might be discrimination". Bullcrap! Stop these psychopaths before they do any more damage.

J.A.D.E. July 17, 2009 12:04 PM

Shakespeare definitely had it right when he sarcastically wrote, "What a piece of work is man!" We are the only beings capable of such inhumanity. Anyone who preys upon the innocent and powerless is not fit to live among us.

iceman July 17, 2009 1:20 PM

put them in a oven. and let them die.or fine them $1,000,000,00 and work 300 hrs at aspca for free.and make them where hat saying i killed these 2 cat in a oven.

Anonymous July 17, 2009 1:29 PM

Please sign care2 petition! http://www.thepetitionsite.com/332/petition-to-have-cheyenne-cherry-tried-as-adult

Have her tried as an adult for the maximum sentence possible. She should be tried as an adult and treated to extreme psychiatric treatments & medication with full 24hr moderation for the rest of her life!! She is a danger to anyone, human or animal, around her.

Anonymous July 17, 2009 1:43 PM

Amen J.A.D.E. I can't say how disturbed I have been since reading this story. I can't wrap my head around the fact that someone would actually do such a horrendous thing to an innocent creature. She should be made an example of and had a much much harsher sentence. 1 year is nothing. And to promise not to keep a pet for 3 years??? How about having no pets for life! And the younger girl? I don't care how old she is, she's old enough to know better too. Make an example out of both of them! Haven't they said that some seriel killers started out torturing animals when they were younger? Put an end to this now before it gets out of control!

Anonymous July 17, 2009 7:59 PM

In my opinion, Cheyenne Cherry and her 14-year-old accomplice are sociopaths. I believe sociopaths are born, not made, and no amount of counseling or therapy will change them. They should be treated as we treat animals with rabies.......they should be put down before they have a chance to torture and kill another living creature.

My only hope is that someone in that jail will be an animal lover and as offended as I am at what those 2 girls did and give Cheyenne Cherry a dose of her own medicine.

Anonymous July 17, 2009 10:31 PM

First off, these people can't be reasoned with or rehabilitated....so unfortunately there is no other way to deal with them but to stoop to the same level. I'm sorry but first, she needs to be smacked for her smart &%$ comment exiting the courtroom...then I think they should stick her in a small prison room and turn the heat up as high as it will go...then the guards should walk away so they don't hear her cries for help. I'm sorry but I've had it with these Animal Abuse stories and our pathetic laws that simply slap the sickos on the hand.

Kathy Watterson July 19, 2009 4:57 AM

This is clearly a sociopath. I've always wondered what kind of people turned on the ovens in the concentration camps and then turned their backs on the anguished cries. This is exactly the type of person the Nazis sought out for that duty.

Can you imagine this woman as a babysitter, a primary schoolteacher, or having any sort of job involving children? Ever???

This ludicrously light sentence may allow Cheyenne Cherry to kill again. But next time, rather than a kitten, it may be your child or your elderly parent. Or maybe a stranger on the street if she's in the mood for a kill. That's what sociopaths are like.

As terrible as the kitten's death was, it's a warning that a potential serial killer is amidst us. If we're lucky, this gal will meet with some sort of bizarre "accident" involving other inmates. Most women in prison are there for non-violent crimes involving need or greed and have a least some core of decency. This is a highly publicized case and there are animal lovers in prison just like anywhere else. Cheyenne Cherry had better hope she isn't assigned duties in the prison kitchen.

And if all else fails and she's released, her picture has been plastered all over the media. I wouldn't want to be in her shoes living in New York City without protection after this.

Nancy July 20, 2009 1:24 PM

I think she should have been put in an oven to die, too!!!! People who are cruel and torture animals like that are sick and will never change! They need to be locked up for life!!!! I'd like to get MY hands on that little brat!!!!! I'd beat some sense into her and torture her the same way...and YES, I could stand there and watch her bake!!!!

Kay July 20, 2009 3:23 PM

Are you kidding me? Jail is too good for her. She needs to be locked up in a cage that gives her just a couple of feet for moving around. Feed her bland dry food and a dish of water with one hour out daily for potty break. She needs to be treated like the animal she is.

Carla July 20, 2009 8:44 PM

Definately a real mental case here! She needs a mental institution for atleast 4 years. This is after her year in jail. Remember Jeffery Dommer? He started with animals! What is happening to our society?? Cherry you need to be put on a desserted island away from any living creature.

Anonymous July 23, 2009 9:49 AM

this is the letter i sent to Bronx prosecutors and the judge:
I have never been to the Bronx, but it must be a God-awful place. To hear of kids like the ones who roasted the six week old kitten for kicks is horrifying. But to hear that the courts there condone such depravity is much more frightening. Drunk drivers spend more time in prison than Cheyenne Cherry will. In all fairness and with all due respect, I do hope that you are her next victim.

Kittykitty July 23, 2009 7:51 PM

It's great to hear this makes other people as angry as it makes me. Miss Cherry is going to get out and have kids - God help them. Please God, let her die first! A horrible, painful death.

Josh July 24, 2009 5:28 PM

I believe this judge needs to be re-evaluated for their ability to provide appropriate judgment.

Evil is evil, this isn't a philosophical debate. What this girl did was evil and wrong. Her punishment should be removing her from society.

Her behavior regarding the situation only proves her inability to understand and accept morality. She should have been sentenced to life.

Jeff July 26, 2009 6:37 PM

Put her in a guy prison for a lifetime and it's all settled.

Richie July 27, 2009 4:22 AM

I think she should be put to death for her horrific crime.

It is satisfying to know that her face is all over the internet and that she will be arriving in jail to a lot of inmates who are waiting to beat the living daylights out of her.

Also she is world famous for being lower than dog crap.

Jennifer July 28, 2009 2:33 PM

It is outrageous and maddening to me that someone with a heart so cruel as to hurt an innocent little kitten because she had "ex-roommate issues" only gets a YEAR in jail! A year!!! I say she should be punished by being strapped down to a chair and people surrounding her with burning candles and flickering lighters at her skin everyday for however old the kitten would be in people years....Animals are a lot like humans, they have needs and they have feelings and emotions. The only difference between animals and people is animals will love you unconditionally and people only love you when they want to...

Bridget July 29, 2009 2:48 AM

Cheyenne and her accomplice have mental issues. This is the making of two future serial killers. First it starts off with torturing and killing an innocent animal, then it goes beyond that. One year is nothing for them to serve. What happens when they get out of jail? What will Cheyenne be in for next, killing a baby,a child, killing anyone because she thinks its a joke? They both need to be locked up in a mental institution and the key thrown away.

Kate July 30, 2009 7:29 PM

Karma will haunt this sick women. 17 with a jail record will make it hard for her to find a job ever. Which will lead to more crime and more time. I hope someone who is in jail with her finds out what she's done and treats her like the ugly b!tch she is.

Anonymous July 30, 2009 7:29 PM

Here's hoping she meets some animal lovers in prison. Would Cheyenne Cherry fit into a prison oven? Or one of those industrial dryers?

I'm hoping to see something to that effect in the papers soon.

Lisa July 31, 2009 5:03 PM

A year ... is that a joke ? She took a life.. just because tiger lily was a cat that pysco gets away with murder, god the justice system is a bigger JOKE, How the hell can you have the thought of this poor innocent kitten crying out for help while being burned alive and give that garbage a year or 6 months. ohhh that really teaches her a lesson you g0 judges !!... Great message to be sent out ! maybe next time the crazy bit*h will do us all a favor an kill herself end up in hell and burn like the trash she is !!

bryan mason August 1, 2009 8:09 PM

she will get equal punishment in prison ugly black ??

Susan Miller August 3, 2009 5:34 PM

I agree with the above posts. I thought the sentence was too light and that is before I read of her previous crimes...She should be sterilized so she is unable to have children and banned from ever owning a pet...

Marilyn Walker August 11, 2009 1:33 PM

It has been proven time and again that those who abuse animals will, in time, abuse people, most likely a child. They enjoy having power over anything that is helpless and cannot defend itself. Yes, the sentence should be harsher, as she WILL in time commit another horrific crime.

William L. Quigley August 11, 2009 2:27 PM

I'm not sure if Ms. Cherry is sociopathic or simply vicious. If she is sociopathic, she needs extensive psychiatric help. If she is a vicious criminal who understands the difference between right and wrong, she needs to be incarcerated for a much longer time than one year. Give her about ten years to think about she's done and the wisdom of avoiding further such acts. The next step for a person like this is cruelty to other human beings. How about notifying her neighbors and employers that she is a torturer of animals? Don't employers and neighbors have a right to defend themselves from her?

Cathy C August 11, 2009 9:03 PM

I don't understand someone like this. How anyone can walk away from the screams of that poor kitten baffles me. No respect for life whatsoever. It sounds like she's treating this whole situation as a joke. I can't imagine the pain the kitten went through. Maybe she should experience a small taste what this kitty felt. This is a dangerous individual. She will be killing a person next. Scary to think. She deserves more than a year.

Angela D. August 12, 2009 9:42 PM

are you seriou? a year? this awful person should be sentenced to life, its the same as killing a human! actually, cheyenne cherry and her terrible friend should get the electric chair and see for themselves how it feels to be fried to death! some people in this world are just sick, heartless wrenches.

karen H August 13, 2009 1:10 AM

What is wrong with her parents? How did they manage to raise this monster? I hope she dies slowly and in great pain.

John Grigsby August 16, 2009 3:03 PM

Put Ms. Cherry into a giant oven and roast her alive until she begs for her life. Then give her the same mercy she showed that poor kitten; walk away.

Max Morrison August 25, 2009 7:43 PM

this person is obviously insane and would be most unfair to let her walk free, for the safety and well-being of society, at least put her in a mental institute until she regains normal consciousness and understands the basic freedoms of all living creatures. she will kill again, whoever the judge is, is highly unqualified and should be part responsible if and when cherry kills again, if I ever see her walking on the streets, she better prey to satan that I don't abduct her, have my way, if karma doesn't get to her first..

Ace September 5, 2009 12:17 AM

She should have been arrested for the gun point abduction. And her excuse, "It was a 'Joke'." Bullshit, go to hell Cheyenne and rest in peace Tiger Lily

Jamie September 9, 2009 7:58 AM

As far as I'm concerned, what she committed was not an act of 'animal cruelty' but accessory to murder. Who are we to claim that an animal's right to life is less than a human's as is currently the case in stautes?

Imogene October 2, 2009 9:46 AM

She is not insane. She is simply evil through and through. Anyone who defends her is an idiot. Her brother, who defended her because he said Cheyenne loved her dog, obviously does not understand that his sister is a "creature" rather than a normal person. She has no sense of empathy or sympathy or the difference between right and wrong. She is, in one word, evil.

B October 26, 2009 9:03 PM

I am wondering what she was charged for robbing the place and the other robberies she committed (I read she held a man at gunpoint for his ipod). And do they think animals are ever going to be safe with her, only saying she can't have a pet for three years? This is not justice.

Jeanmarie November 16, 2009 10:30 PM

There was a case here on the coast where a man poured gas on a kitten and lit a match at a bus stop. He got 3 years. I hope she does not get probation - at least.
