Attorney Uses "Pit Bulls Did It" Defense For Accused Miami Dade Cat Killer

Published May 26, 2010
Just about a year ago I posted an extremely gruesome story concerning the arrest of 19-year-old Tyler Weinman, suspected of wantonly mutilating and killing 21 cats in Cutler Bay and Palmetto Bay, located in Broward County in the Miami-Dade Florida area. Apparently the suspected teen-age perpetrator, who was accused of committing the wanton rash of acts of animal cruelty, went on a rampage of murdering 21 innocent outdoor cats in these neighborhoods. And since the descriptions of these crimes are extremely brutal and gory I won't repeat all the highly disturbing details. Due to the highly alarmed and terrified neighborhood cat owners, Palmetto Bay Mayor, Mayor Eugene Flinn, advised people to keep their cats indoors until a determination of the cause of these feline deaths could be made, and until such time there was no longer a risk to the feline population. Additionally, The Humane Society of the United States offered a $2,500 reward for information leading to the arrest and conviction of what they referred to as "serial cat killings.'' And while there was no forensic evidence proving that Weinman killed these cats, according to an item on change.org, police reported that in an interview, Weinman attempted to cut a deal. Quoting Weinman, "OK, so let me see if I understand. As long as I tell you about the cats that I did, you can get rid of the others?" But he immediately called his attorney before he made any confession. So let's fast- forward to the present. Apparently Weinman's attorney is now resorting to the "Pitbulls did it" defense for his client. His attorney possibly may be justifying it based on test results obtained from 11 of the slain cats which yielded no human DNA. However results from scalpels and other evidence taken from Weinman's residence have not yet been received. What I don't understand about this defense, which seems to me to border on that famous "Twinkie" defense used in California during the 1979 trial of former San Francisco Supervisor Dan White. White, who assassinated Mayor George Moscone and Supervisor Harvey Milk, was convicted of Voluntary Manslaughter instead of murder. His attorney justified White's acts based on his long string of hardships resulting in extreme depression. This depression caused White to consume sugar-rich junk food, which was responsible for White's rational thought to be diminished. Incredibly this defense was successful as it convinced jurors that these slayings were not premeditated. Jurors convicted White of Voluntary manslaughter instead of murder. While it is true that dogs may attack cats and kill them, unless there are some very surgically adept Pitbull dogs roaming in the Broward County area, I think that Weinman's attorney's defense is improbable, flimsy and unfairly prejudicial. Pitbull dogs are far too often wrongly accused and conveniently blamed for violent behavior. Besides, dogs don't "skin", "bash in" or surgically "decapitate" their victims. As far as I am concerned, based on the physical description of the appearance of the slain cats, someone must have gone out of their way to be very careful about not leaving any traces of their DNA or other identifying evidence. Additionally with the discovery of scalpels at the Weinman home, while it is circumstantial evidence, it seems to be rather compelling to me. While Weinman faces 21 charges of animal cruelty, to be fair he must still be considered innocent until proven guilty by a jury of his peers. I dearly hope that the accused Pitbull dogs receive the same respect they deserve and that the jury examines all the evidence with an open mind to arrive at an unbiased decision. Well this certainly sounds like the classic case stuides of killers. I am currently getting my Master's degree in psychology at my local university and this is classic symptoms of an anti-social child. These people always beging with some form of obsessions or thoughts about killing, then they take it to small animals and if the behavior is increasing the most obvious next step is killing humans. I certainly have my own biased opinion in this case because I am a proud owner of two Basset Hounds, Lizzy and SPencer, and an American Pit Bull Terrier, Remi. I can honestly say I have educated myself and continue to everyday to learn behaviors and keep my dogs balanced and happy. I know for a fact my dogs would never harm anyone unless they felt threatned, but this again ties into BEHAVIOR. Of course there are wild packs of dogs that will see small animals as prey, as they SHOULD they are in fact ANIMALS that's is how they function. For people to say it is the "PIT BULL" breed is completely IGNORANT. I take my Bassest Hounds on monthly hunting trips and I have seen them do some devistation to some of our catches, when you have a pack of dogs of course they will engage in pack like behavior, its thousands of evolutionary DNA that is instilled into them. If you take the time and educate yourself you can have a balanced pack that wont harm and wont have that pack like behavior. As far as bashing both breed and this kid there obviously needs to be suffient evidence supporting the case. Of course for anyone to say that a dog, ANY DOG, can surgically remove cats heads and have them bashed in must be severely ignorant and for lack better terms STUPID. (my own opinion again). It is sad how this has hurt a community and lives. As long as both parties are seen fit to justice that is the biggest picture. We need to understand that it is not BREED, it is ANIMAL, DOG, then BREED!!!! As far as the kid involved if proven guilty hopefully some help will be given to him and he will serve, if found not guilty hopefully he can return to normal life.

Dear Sam Slick: obviously, if there is a necropsy performed on an animal, they can tell what fluids are organic and which ones are'nt,just like people. Even if they haven't submitted it as evidence, they still know. I pray that someone helps save this boy before he finds out that what he did to those cats is NOTHING compared to what waits for in Hell. He's on my prayer list.

cats: do not bend, fold or mutilate

How many cats have been found mutilated in similar manner(s) since he was arrested? If the answer is none, or a statistically significant decrease, doesn't that say something?

We lost one cat and almost lost another one to two pitbull mixes that were owned by a Probation Officer that had recently moved to our county to avoid similar problems from the county she had just moved from. It wasn't until I uncovered records filed with the County Clerk and presented them to our City Municipality that they started to move against this pet owner. My husband and I are animal lovers, and we know that this type of animal behavior begins with a careless animal owner. She provided them with shelter and food, but nothing else. She lied to law enforcement etc. She doesn't live here anymore thank god, but I doubt she learned anything. I wish they had a database for people to file this information in to keep track of these people and their dangerous pets. In the end her one dog was euthanized, but the other once had learned alot, maybe he's still with her, but in a new place!

There is no way that a dog killed those cats. Dogs will rip their prey apart and leave it there, they dont bring it back to the place it was killed, nor do they cut off their heads, (unless they somehow grew opposable thumbs..). & the evidence against this kid is very very good, the GPS tracking, and how his new step-mother has 10 cats.

This kid did it one way or another.. but I agree that it needs to be proved with evidence.. if not then we all stand to be accused and convicted of anything at anytime.. If the dogs did kill all those cats, how did they get them? Most cats are smart enough to notice that a dog is aggressive and stay away.. especially after so many... It doesnt make sense to me that 21 cats at differnt times happen to wander into this yard with aggressive dogs.. It sounds to me like this guy was training his dog to fight..
